Terms of Service

Who we are and what these terms cover

These Terms of Service ("Terms") are an agreement between Lease Pace TYH LLC ("LeasePace," "we," "us") and the business or person that signs up for LeasePace ("Customer," "you"). They cover your use of leasepace.io and the LeasePace platform, including Pace, our AI leasing assistant (together, the "Service").

LeasePace is built for property managers, landlords and leasing teams. Renters and prospects who text or message your number are communicating with your business. LeasePace provides the technology you use to answer them.

By creating an account, booking setup, or using the Service, you agree to these Terms. If you're accepting on behalf of a company, you confirm you have authority to bind it.

Accounts

You must be at least 18 and provide accurate account and business information. You're responsible for everyone you give access to, for keeping login details secure, and for all activity under your account. Tell us promptly at privacy@leasepace.io if you believe your account has been accessed without permission.

The Service

The Service includes messaging (SMS, WhatsApp and email), phone calls with call recording, transcripts and AI call summaries, and AI-generated replies from Pace. It also includes task management, calendar and tour scheduling, a leasing pipeline, rental applications, tenant screening through your own Weimark account, and e-signature. We may improve, change or add features over time. If we remove something material that you rely on, we'll give you reasonable notice.

Calls through the Service ring your team. Recording is on by default for your whole account. If you want it off, ask us. Voicemails are always recorded. "Phone calls and call recording" in our Privacy Policy explains the recording notice and how our transcription and AI providers process calls.

We set up the Service for you, including connecting your number and loading your units, availability and rules, based on the information you give us.

Fees and billing

Subscription. The base subscription is $97 per month, billed monthly in advance, unless a different price is agreed in writing.

Usage. AI features, translation, text messages, phone calls and phone numbers are billed separately, based on your usage, in addition to the subscription. Registering your number with carriers for text messaging is a one-time charge.

Promotions. Pilot or promotional offers (for example, a period with no base charge or included usage credit) apply only as described in writing when you sign up, and end on the date stated.

Payment. You authorize us and our payment processor to charge your payment method for subscription and usage fees, plus applicable taxes. If a payment fails, we may suspend the Service until it's resolved.

Cancellation. You can cancel at any time. Cancellation takes effect at the end of your current billing period. Fees already paid are non-refundable except where the law requires otherwise.

Your responsibilities

You're responsible for how you use the Service to communicate with renters and run your leasing, including making sure you:

  • Comply with fair housing laws, including the federal Fair Housing Act and applicable state and local laws.
  • Comply with messaging and email laws and rules, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, carrier and CTIA requirements, and WhatsApp Business policies.
  • Have the right to message, call and email the people you contact, and get any consent the law requires.
  • Comply with call-recording laws, including in states where everyone on a call must agree to be recorded. Give any notice or get any consent the law requires, even though we normally play a recording notice.
  • Use tenant screening reports only for a permissible purpose under the Fair Credit Reporting Act (FCRA) and similar state laws. Follow Weimark's terms, and send any adverse-action notice the law requires.
  • Follow any law that limits when or how you may consider criminal history or eviction records, including if you choose to have screening reports start automatically.
  • Use secure methods whenever you dispose of screening reports, as the FCRA and state law require.
  • Give people outside your business, such as a management company's staff or a caseworker, access to renters' information, including screening reports, only where the law allows it.
  • Tell your team members that we record their sign-in and activity information and their calls. Give any notice the law requires for monitoring employees.
  • Give us accurate information about your units, prices, availability, policies and screening criteria.
  • Make all leasing decisions yourself, including approving or denying applications.

Deleting something in LeasePace doesn't always delete it from services you've connected, such as your Weimark account. While a service is connected, information from it may be brought in again. Results copied onto a renter's record, such as credit score, stay until you delete that record, and some other files and records may remain. See "Data retention, deletion and export" in our Privacy Policy.

How Pace works

Pace is an automated assistant. It answers renter messages using the information and rules you provide, asks qualifying questions, offers tour times and hands conversations to your team when something is unusual. Pace can see some screening results, such as credit score, and may use them in conversation.

Pace is designed to introduce itself as an AI assistant when it's the first to write to a renter. You're responsible for any other disclosure the law requires. Pace does not approve or deny applications and does not make leasing decisions. Like any automated system, it can make mistakes. You're responsible for reviewing its configuration and conversations and correcting information that's out of date. Nothing Pace says is legal, financial or tax advice.

Messaging

Texts and WhatsApp messages sent through the Service are sent on your behalf, from the number connected to your account. Emails are sent from a LeasePace address under your business name.

When someone replies to a text or WhatsApp message with STOP, or a similar opt-out word on its own, we honor it automatically. We do the same when someone uses the unsubscribe link in bulk emails about available units. You're responsible for honoring any other request to stop, such as a renter asking in their own words, by phone or by email. When someone replies HELP, the message reaches your team. You're responsible for making sure anyone who asks for help gets your business's name and contact information.

By default, the Service also texts callers whose calls you miss. You can change or turn off that text in Settings. Message and data rates may apply to recipients. Delivery depends on carriers and third-party platforms, and we can't guarantee that every message is delivered.

Acceptable use

You agree not to use the Service to:

  • Send spam, unsolicited marketing, or messages to people who haven't agreed to receive them where consent is required.
  • Discriminate against anyone, or send content that is unlawful, harassing, deceptive or misleading.
  • Interfere with, overload, reverse engineer, or try to get unauthorized access to the Service.
  • Resell the Service, or let more than one person use the same login, without our written permission.

You may give logins to people outside your business, such as a management company's staff or a caseworker, for your leasing work. You're responsible for them as described in "Accounts."

We may suspend or limit access if we reasonably believe the Service is being used in violation of these Terms or the law.

Your data

You own the data you and your renters put into the Service, including conversations, call recordings, applications and documents. This data, together with the screening reports you get through the Service, is "Customer Data." Screening reports are also subject to Weimark's terms. You give us permission to host, process and transmit Customer Data only as needed to provide and support the Service, and as described in our Privacy Policy.

You also give us permission to review Customer Data, such as conversations, to find and fix problems and improve the Service. For example, we may test changes to Pace against past conversations. You're responsible for making sure your own privacy notices to renters allow this. We don't use Customer Data to train AI models. Our transcription provider may use call audio to improve its own speech recognition under its terms, and our other service providers process the data they receive under their own terms.

Your account's owners, and admins with export permission, can export some Customer Data themselves, such as contacts, units and tours. Cancelling your subscription doesn't delete Customer Data. To close your account and delete Customer Data, one of your account's owners can email privacy@leasepace.io. We'll delete it, except where the law requires us to keep it. Stored files, some records, and copies held by our service providers may remain after deletion.

A call recording is normally removed from the app about 90 days after the call. If you need one kept longer, ask us before then. "Data retention, deletion and export" in our Privacy Policy explains what can be exported and when call audio is erased.

Third-party services

The Service relies on third-party providers. These include:

  • Vercel, Supabase and Cloudflare, for hosting, storage and delivering our website.
  • Twilio and WhatsApp, for calls and messages.
  • Resend, for email.
  • Anthropic, for AI.
  • Deepgram, for call transcription.
  • Google, for maps, translation, sign-in, fonts and YouTube.
  • Stripe, for our own billing.

Some features connect to accounts you hold elsewhere, such as your Weimark account for tenant screening and your Google Calendar and Google Sheets. Their own terms may apply to your use of their services. We're not responsible for outages or changes outside our control.

11

Intellectual property

We own the Service, including its software, design and content, other than Customer Data. These Terms don't give you ownership of any of it. If you send us feedback or suggestions, we may use them without obligation to you.

↑ Contents
12

Confidentiality

Each of us will keep the other's non-public business information confidential and use it only for the purpose of these Terms, except where disclosure is required by law.

↑ Contents
13

Term, suspension and termination

These Terms apply for as long as you use the Service. You can stop at any time by cancelling. We may suspend or end your access if you materially breach these Terms, don't pay, or use the Service in a way that creates legal risk or harm to others. Sections that by their nature should survive (such as fees owed, disclaimers, limitation of liability and indemnification) survive termination.

↑ Contents
14

Disclaimers

The Service is provided "as is" and "as available." To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee any particular result, including leases signed, occupancy, or response times. Any figures we publish, such as median reply time, describe past measurements and are not guarantees.

↑ Contents
15

Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenue. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the claim arose.

↑ Contents
16

Indemnification

You'll defend and indemnify LeasePace against third-party claims arising from your messages, your leasing decisions, your Customer Data, or your violation of these Terms or the law, including fair housing and messaging laws.

↑ Contents
17

Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in the State of New York, and both parties consent to that jurisdiction.

↑ Contents
18

Changes to these terms

We may update these Terms. If a change is material, we'll notify you by email or in the Service before it takes effect. The "Last updated" date at the top shows the latest version. Continuing to use the Service after changes take effect means you accept them.
